Terms and Conditions
1. Purpose
These General Terms and Conditions of Sale (hereinafter the "GTC") govern all product sales made on the Mister Montre website (hereinafter the "Site"), operated by Mister Montre, a sole proprietorship under Swiss law.
2. Scope of Application
These GTC apply to any order placed on the Site by any adult individual acting as a consumer (hereinafter the "Customer").
Any order implies full and unreserved acceptance of these GTC.
3. Products
The products offered for sale are described and presented with the greatest possible accuracy. However, minor variations may exist, particularly due to manufacturing constraints or visual representation.
Some products are offered in limited editions. Their availability is guaranteed while supplies last.
4. Price
Prices are indicated in Swiss francs (CHF), all taxes included, excluding delivery costs, unless otherwise stated at the time of order.
Shazan Corp reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order confirmation.
5. Order
The Customer places an order directly on the Site. The order is considered firm and final upon payment confirmation.
We reserve the right to refuse or cancel any order in the event of an existing dispute with the Customer, suspicion of fraud, or non-compliance with these GTC.
6. Payment
Payment is made online via the methods offered on the Site at the time of order. Transactions are secured via the payment providers used by Shopify.
The order will only be processed after effective receipt of payment.
7. Delivery
Products are delivered to the address indicated by the Customer when placing the order.
Delivery times are provided for informational purposes only. We cannot be held responsible for a delivery delay beyond our control (carrier, customs, exceptional events, etc.).
It is the Customer's responsibility to verify the accuracy of the information provided (address, email, phone number). In case of error, costs related to re-shipment may be borne by the Customer.
8. Right of Withdrawal
The Customer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal, without having to justify any reason, subject to applicable legal exceptions.
The product must be returned in its original, unused condition and in its original packaging. Return costs remain the responsibility of the Customer.
9. Returns and Refunds
After receipt and inspection of the returned product, Shazan Corp will refund the amounts actually paid for the product concerned, within a maximum of fourteen (14) days.
Initial delivery costs may not be refunded when applicable law permits or depending on the chosen delivery method, in accordance with the information provided at the time of purchase.
10. Prize Draw Associated with Certain Products
The purchase of certain products may include participation in a prize draw. The terms and conditions of this draw are defined in a separate regulation accessible on the Site ("Game Rules" page).
11. Warranties and Liability
We undertake to provide products that conform to the description on the Site. Our liability cannot be engaged in case of indirect damages, loss of operation, or intangible prejudice.
Our liability is, in any event, limited to the amount actually paid by the Customer for the order concerned, subject to applicable mandatory legal provisions.
12. Force Majeure
We cannot be held responsible if the performance of our obligations is delayed or prevented due to an event beyond our control, qualified as force majeure according to applicable jurisprudence.
13. Intellectual Property
All elements of the Site (texts, visuals, logos, brands, designs) are protected by intellectual property rights. Any unauthorized reproduction or use is strictly prohibited.
14. Personal Data
Personal data collected is processed in accordance with current Swiss legislation (LPD) and, where applicable, the GDPR. Full details are described on the "Privacy Policy" page.
15. Applicable Law and Competent Jurisdiction
These GTC are subject to Swiss law.
Any dispute relating to their interpretation, execution, or validity falls within the exclusive jurisdiction of the courts of Hazan Mister Montre's registered office, subject to applicable mandatory legal provisions.
